1. Eligibility and Age Requirements

1.1 Minimum Age

Floor63 is intended for users aged 13 and above. By accessing the Platform, you represent and warrant that:

• You are at least 13 years of age;
• If you are between the ages of 13 and 17, you have obtained verifiable consent from a parent or legal guardian;
• You have the legal capacity to enter into a binding agreement with Floor63;
• Your use of the Platform does not violate any applicable laws or regulations in your jurisdiction.

1.2 Users Under 18

If you are under 18 years of age, your parent or legal guardian must review and agree to these Terms on your behalf. By permitting a Minor to use Floor63, the parent or guardian agrees to be bound by these Terms with respect to that Minor's use of the Platform. We recommend that parents and guardians actively supervise Minor users' interactions on the Platform.

1.3 18+ Rooms and Content

Certain game modes on Floor63 are designated as 18+ content. Users must be at least 18 years of age to access or participate in Adult Content. By entering an 18+ designated session, you:

• Confirm that you are at least 18 years of age;
• Acknowledge that Floor63 does not employ mandatory age verification technology and relies on self-declaration;
• Accept full responsibility for any misrepresentation of your age;
• As a host, accept responsibility for taking reasonable steps to prevent Minors from accessing 18+ content in rooms you create or manage.

Floor63 reserves the right to remove access to 18+ content for any user at any time without prior notice or explanation.

2. Access, Accounts, and Registration

2.1 No Account Required

Floor63 currently allows users to access the Platform without creating a formal account. Users enter a display name and join or create rooms directly. We reserve the right to introduce account registration requirements at any time.

2.2 Display Names

Your display name must not impersonate any real person or entity, contain offensive or sexually explicit language, include personally identifiable information about yourself or others, or violate any third-party intellectual property or trademark rights.

2.3 Room Codes and Access

Floor63 generates unique room codes to enable private sessions. You are responsible for controlling access to room codes you create or share. We are not responsible for unauthorised access to rooms resulting from your sharing of room codes with unintended parties.

3. Nature of the Platform

3.1 User-Generated, Real-Time Communication

Floor63 is a real-time communication platform. Content generated, shared, spoken, and displayed during sessions is created entirely by users. Floor63 does not pre-screen, moderate in real time, or review user interactions. We are not responsible for the accuracy, appropriateness, or legality of any user-generated content.

3.2 Live Video and Audio

The Platform enables live video and audio communication between consenting participants. By enabling your camera and microphone, you consent to transmitting audio-visual data to other participants in your session. You are responsible for ensuring your environment and conduct during video sessions is appropriate. You assume all risks associated with live camera and audio transmission to other users.

3.3 Game Content

Floor63 provides structured party games as entertainment features. While we endeavour to ensure game content is appropriate for the designated age group, some content may require user judgment. Floor63 is not responsible for how users interpret, adapt, or respond to game content during live sessions.

4. Acceptable Use and User Conduct

4.1 Prohibited Conduct

By using Floor63, you agree not to:

4.1.1 Harmful Behaviour

• Harass, threaten, intimidate, bully, or abuse any other user;
• Engage in hate speech targeting any person or group based on race, ethnicity, national origin, gender, sexual orientation, disability, religion, or any other protected characteristic;
• Encourage or facilitate self-harm, eating disorders, substance abuse, or other harmful behaviour;
• Share content that sexualises, exploits, or endangers minors in any way.

4.1.2 Illegal Activities

• Use the Platform for any unlawful purpose or in violation of any applicable laws;
• Transmit, display, or share illegal content of any kind, including child sexual abuse material (CSAM);
• Engage in fraud, identity theft, or any deceptive practice;
• Facilitate gambling, drug transactions, or any other regulated activity without appropriate authorisation.

4.1.3 Platform Integrity

• Attempt to hack, reverse-engineer, or decompile any part of the Platform;
• Introduce viruses, malware, bots, or other harmful code;
• Attempt to gain unauthorised access to other users' data or any backend systems;
• Use automated tools or scripts to interact with the Platform without prior written consent;
• Artificially disrupt or overload the Platform's infrastructure.

4.1.4 Privacy Violations

• Record, screenshot, or capture other users' video or audio without their explicit consent;
• Share, distribute, or publish any recording of another user without their consent;
• Dox, share, or threaten to share personally identifiable information about another user;
• Stalk or persistently contact any user who has not consented to further contact.

4.2 Host Responsibilities

If you create a room on Floor63, you accept additional responsibilities. You must not knowingly permit Minors to access 18+ content. You are responsible for sharing room codes only with intended participants. You should use available in-session controls to remove disruptive or harmful participants.

4.3 Enforcement

Floor63 reserves the right, but is not obligated, to monitor user conduct and to take any action we deem appropriate in response to violations, including removing content, suspending or terminating access, reporting illegal conduct to law enforcement, and cooperating with legal investigations.

Floor63 operates a zero-tolerance policy regarding child exploitation material. Any suspected CSAM will be reported immediately to the relevant authorities including the National Center for Missing and Exploited Children (NCMEC) and equivalent bodies in applicable jurisdictions.

5. Intellectual Property

5.1 Floor63 Intellectual Property

The Floor63 name, logo, platform design, game mechanics, source code, and all related materials are the exclusive intellectual property of Floor63 and its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform for personal, non-commercial entertainment purposes only.

5.2 User Content

You retain ownership of any content you create during sessions. By using the Platform, you grant Floor63 a worldwide, royalty-free, non-exclusive licence to use, process, and transmit your content solely for the purpose of operating and improving the Platform.

6. Disclaimers and Limitation of Liability

6.1 Platform Provided "As Is"

Floor63 is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

6.2 Limitation of Liability

To the maximum extent permitted by applicable law, Floor63 and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or goodwill; personal injury or emotional distress; or any matter beyond our reasonable control.

In no event shall Floor63's aggregate liability to you exceed the greater of (a) the amount you have paid to Floor63 in the twelve months preceding the claim, or (b) one hundred United States Dollars (USD $100).

6.3 Third-Party Services

Floor63 may integrate third-party services including video infrastructure providers, analytics tools, and cloud services. Your use of any third-party services is subject to their respective terms and privacy policies. Floor63 is not responsible for the practices, availability, or content of any third-party services.

7. Privacy and Data

Your privacy is important to us. Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Floor63, you consent to the collection and use of your information as described in the Privacy Policy.

8. Termination and Suspension

8.1 Termination by Floor63

We reserve the right to suspend or permanently terminate your access to the Platform at any time, for any reason, with or without notice, including for violation of these Terms, conduct posing a risk to users or the Platform, or in response to legal obligations or law enforcement requests.

8.2 Effect of Termination

Upon termination, your right to access and use Floor63 ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, limitation of liability, and dispute resolution clauses.

9. Governing Law and Dispute Resolution

9.1 Governing Law

These Terms are governed by and construed in accordance with applicable law. As Floor63 operates internationally, we apply general principles of internet law and consumer protection broadly recognised across jurisdictions. Users in specific regions may have additional rights under local law that these Terms do not override.

9.2 Informal Resolution

In the event of any dispute arising from your use of Floor63, please contact us at contact@floor63.com in the first instance. We will make a genuine effort to resolve disputes informally and promptly.

9.3 Limitation Period

To the extent permitted by applicable law, any claim arising from your use of Floor63 must be brought within one (1) year of the date on which the cause of action arose, after which such claim is permanently barred.

10. Modifications to These Terms

Floor63 reserves the right to update, modify, or replace these Terms at any time. When we make material changes, we will update the Effective Date. Your continued use of Floor63 after changes are posted constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

11. General Provisions

11.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional guidelines posted on the Platform, constitute the entire agreement between you and Floor63 regarding your use of the Platform.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver unless acknowledged and agreed to in writing by Floor63.

11.4 Assignment

You may not assign these Terms without the prior written consent of Floor63. Floor63 may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
